All deliveries and internet services provided by Bermi S.A. under www.alver.ch (“the website”), are governed by the following general terms and conditions of sale. By placing an order the customer acknowledges having read, understood and accepted them without reservation.
Bermi S.A. accepts no alternative conditions put forward by the customer. Bermi S.A. reserves the right to amend these general terms and conditions at any time by publishing a new version on this website. When placing an order, the customer shall be deemed to have accepted the terms and conditions as published at the time of the order.
When placing an order on the website, the customer can register and open a personal account. However, the customer can order without creating an account; the data provided will only be used to manage the order itself. Whatever the method of placing an order, the customer must ensure the accuracy and completeness of the data provided during the ordering process.
If a personal account has been opened, the customer is responsible for keeping their data up-to-date. Only people who have reached the age of 18 are entitled to register.
The customer agrees to keep their chosen registered personal password strictly confidential and not to disclose it to third parties. The customer assumes full responsibility for the use of their password and all orders placed, even without their knowledge, using this password.
The customer may at any time request to stop receiving advertising in connection with Alver by sending an e-mail to firstname.lastname@example.org or a letter to Bermi S.A., Consumer Service, chemin de la Baume 21, 1803 Chardonne, Switzerland.
By placing an order, the customer commits to purchasing the products ordered in accordance with our general terms and conditions. For each order placed through the website, a confirmation e-mail is sent. Until written confirmation has been issued by Bermi S.A, orders placed through the website do not constitute a binding contract for Bermi S.A.
The price and description that apply to the product ordered shall be those provided on the website on the date of the order. If a product that has been ordered cannot be delivered, the customer shall be informed accordingly. Bermi S.A. reserves the right to refuse any order exceeding the price of CHF 1,000.
Bermi S.A. reserves the right to refuse any order in particular if payment has been blocked by the customer’s bank.
Orders shall be delivered to the address provided by the customer. Responsibility for the goods is transferred to the customer upon receipt by the carrier, the Swiss postal service. Postage costs apply for orders under CHF 25.
5. Checks and returns
It is the customer’s responsibility to check the quantity and condition of the goods on delivery. If goods are missing or damaged, the customer must file a complaint with Bermi S.A. and the Swiss Postal system within 7 days of delivery by sending an email to email@example.com.
Before returning any goods the customer must write to firstname.lastname@example.org. Unless if otherwise agreed, any postage or other fees are to be borne by the customer and the payment shall be credited to their personal account on the website.
Prices stated on the website include VAT, as do delivery costs. Bermi S.A. reserves the right to adjust prices and delivery costs at any time.
7. Payment Terms
Payment is to be made before goods are delivered, either by credit card (Visa/Mastercard) or by PayPal. Credit card data is encrypted for data protection. Goods shall be delivered to the address provided upon receipt of payment.
Without limiting the scope of these general terms and conditions, no claim whatsoever for missing or damaged goods, failure to deliver goods, or any other claim may exceed the purchase price of the order in question. BERMI S.A. shall in no way be held liable for any indirect or accidental damage whatsoever (even if BERMI S.A. knew or may have known of the emergence/possibility of such damage) resulting from or relating to its products, their use, their sale or this website.
9. Applicable law and jurisdiction
These general terms and conditions are governed by Swiss law. The place of legal proceedings is Vevey.
